General condition of use of the vehicle conveying service

Mr. Jean-Philippe HYGONNET operating under the name TRANSBAGAGES, a company in a personal name registered with the RCS of MENDE under number 387 702 533 000 51, whose head office is located in Hameau Chanteruejols, 48000 MENDE.
THE FOLLOWING WAS AGREED:

Article 1 - PURPOSE

By this contract, TRANSBAGAGES undertakes to transport your vehicle.
In return, the customer undertakes to pay TRANSBAGAGES at the fair value of its service and in accordance with the price agreed in article 3 of this contract.

Article 2 - EXECUTION PROCEDURES

Upon receipt of the confirmation, the customer must complete the “vehicle transfer contract”, which will be the subject of a report drawn up by the contracting parties. Each of the parties will have a copy of the minutes thus drawn up and signed.
The customer must return the vehicle to TRANSBAGAGES with the fuel tank full or filled in such a way as to allow TRANSBAGAGES to carry out the trip ordered.
In addition, the customer will entrust TRANSBAGAGES with the vehicle's current vehicle registration document and insurance certificate. Trip: The parties agreed on the trip when booking on the site. www.transbagages.com.
The customer declares to accept the itinerary used by TRANSBAGAGES. Any delay and/or change of itinerary resulting from a cause unrelated to TRANSBAGAGES is already accepted by the customer. This includes, in particular, the establishment of road detours, roadway work, high traffic density, the occurrence of an accident or weather conditions.
In addition, the customer accepts that the vehicle can make a detour in order to be stored in the TRANSBAGAGES warehouse, located at 1 rue de l'école hamlet of Chanteruejols, 48000 Mende.
The customer is required to reimburse TRANSBAGAGES's transport costs upon presentation of invoices or any other supporting document, in particular toll and fuel costs in addition.
Delivery of the vehicle at the point of arrival: TRANSBAGAGES will deliver the vehicle to a trusted person determined by mutual agreement with the customer when booking. Once the vehicle keys have been handed over to the host, Transcannot be held responsible for any damage that may occur in the car park. The customer undertakes to give the keys and the vehicle papers to the accommodation provider at the start of the hike. We will return the keys to the accommodation mentioned in the reservation upon arrival. The customer is requested to inform the owner of the premises upon departure as well as upon arrival.

Article 3 - PRICES. BILLING. PAYMENT
The customer undertakes to pay the price agreed with TRANSBAGAGES: The customer is informed that the administrative fees will not be reimbursed in the event of cancellation of the reservation. In case of cancellation, any reservation may be cancelled by the customer under the following conditions:
- More than 2 weeks before the service: 50% refund
- Less than 2 weeks before the service: no refund.
If Transbagages is required to add fuel to complete the service, Transbagages undertakes to provide an invoice to the customer with the dated and signed cash register receipt that the customer must pay within 10 days.

Article 4 - OBLIGATIONS OF THE PARTIES - Obligations of the customer
In the name of its duty to perform the contract in good faith, the customer undertakes to facilitate the performance of the service by TRANSBAGAGES. As such, the customer undertakes to provide him with all the vehicle's administrative documents, the insurance policy certificate and any other necessary document.

- Obligations of the service provider
TRANSBAGAGES undertakes to perform the service that is the subject of this contract. TRANSBAGAGES is bound by an obligation to preserve the vehicle entrusted by the customer and is only responsible for his fault.
TRANSBAGAGES undertakes to inform the customer as soon as possible of a possible claim, it is up to the owner of the vehicle to file the claim with his insurer. For its part, TRANSBAGAGES will report the claim directly to its own insurer. If the vehicle perishes due to its own defect or as a result of a fortuitous event or force majeure, the customer will be required to bear the loss and to pay TRANSBAGAGES the remuneration that will correspond to the work performed. TRANSBAGAGES is committed to respecting the obligations of the Highway Code; any offenses committed during the transfer may affect it. TRANSBAGAGES is only responsible for its fault.

Article 5 - PROVIDER'S INSURANCE

TRANSBAGAGES guarantees the customer that for the duration of this contract, it is the holder of a contract and an insurance policy guaranteeing the pecuniary consequences of its civil liability as a result of the execution of the contract. At the date of this contract, TRANSBAGAGES declares the following elements:

* Date Birth of the manager: 13 March 1969
* or employees who meet the regulatory requirements
* Driver insurance:: AREA 4800 Mende

Article 6-TERMINATION OF THE CONTRACT

In the event that either party does not comply with the obligations of this contract, it shall be automatically terminated if the defaulting party does not remedy its breach within 30 days from the date of issue of a notification issued by the other party, in the form of a registered letter with acknowledgement of receipt. This contractual termination of the contract is not prejudicial to the judicial award of any damages for the party who suffers damage as a result of the non-performance of the contract by the other party.
